HOA Flood Records & Documentation
Florida SB 948 (effective October 1, 2025) requires condo and co-op developers and sellers to disclose flood history for common elements under §718.503 and §719.503 F.S. HOA boards must now maintain reliable flood documentation to avoid liability at resale.
Why boards must act now
Under SB 948, buyers have a 15-day right to cancel if flood disclosures are missing or materially misleading. A board that cannot produce a credible flood event history for common elements exposes the association to:
- Buyer cancellation of unit sales — disrupting owner exit transactions
- Civil liability for fraudulent or negligent misrepresentation
- Insurance coverage disputes if undisclosed flood history surfaces during a claim
- Lender scrutiny — mortgage lenders increasingly review flood disclosure compliance
